Controversies arise when Paris Barguette, a leading Korean bakery brand, came up with a hiring plan for the illegally used subcontracted bakers through the establishment of a partnership company with the participation of Paris Barguette headquarters, partner firms and chain stores, which is the rejection of the order of direct employment issued by the Ministry of Employment and Labor. Some of subcontracted bakers who had already signed the agreements for their employment by the partnership company withdrew their earlier consents, citing "the forced agreements". The organized labor, civic and social groups are strongly opposing the indirect employment plan.

According to the Civic and Social Countermeasures Committee to resolve the problem of illegally dispatched Paris Barguette bakers and to secure the labor rights of young workers with the participation of the Korean Confederation of Trade Unions, Korean Chemical and Textile Workers Union, and People's Solidarity for Participatory Democracy on December 3, Paris Barguette made public on December 1 the launch of a partnership company named "Happy Partners" and explained that about 3,700 out of 5,300 subcontracted bakers(70%) opposed the direct employment by the head office but agreed to the employment by the partnership company.

According to the Civic and Social Countermeasures Committee, about 200 subcontracted bakers sent letters to the Korean Textile and Chemical Workers Union, withdrawing their agreements signed earlier with Paris Barguette. "The subcontracted bakers were forced to sign the agreement by the partner firms to give in the direct employment and now they speak their minds by withdrawing the signed agreements." a union official said. " Because there are many more workers who cannot submit the withdrawals for fear of disadvantages, the signed agreements cannot be the exact reflection of the real intentions of workers."

The Countermeasures Committee also expressed its disappointments that while Paris Barguette, partner firms and chain stores refusing dialogue with the union representing subcontracted bakers, but they pushed ahead with the establishment of a partnership company. The Countermeasures Committee criticized in the statement that "Paris Barguette, the direct party illegally used dispatched bakers, is just waiting for the conclusion of the incident without dialogue with the workers who are stakeholders. The establishment of 'Happy Partners' which is merely an employment agency cannot be a solution to address the problem of illegal dispatching of workers."

In the meanwhile, Paris Barguette is expected to save a considerable amount of fines imposed for non-compliance with the order of direct employment, due to the establishment of a partnership company. If the company does not comply with the correction order, it shall be fined to a maximum of 10 million won(US$ 9,180) per worker, with a total of 53 billion won(US$48.7 million). As the number of subcontracted bakers who have already signed the agreement for the employment through the partnership company is not included in the imposed fines, Paris Barguette shall pay only 16 billion won(US$ 14.7 million) as fines. The correction order should be implemented by December 5.
