It became clearer that Oxy Reckitt Benckiser(RB Korea) will not accept the order of reinstatement adjudicated by the National Labor Relations Commission(NLRC) at all, when on October 20 Park Dong-suk, head of RB Korea filed an administrative litigation with the Seoul Administrative Court against the National Labor Relations Commission(NLRC) to annul the adjudication for the reinstatement of dismissed workers. Earlier on October 11, RB Korea Chief Executive Park Dong-suk, who was grilled by the lawmakers of the Environment and Labor Committee in the parliamentary audit and inspection of the Ministry of Employment and Labor, answered that "Due to the plunge of sales, the employees on the payroll even shall be further reduced."

On November 30 last year, RB Korea closed down a plant in Iksan, North Jeolla Province which produced laundry detergents and moisture absorbers, unrelated to the products of the toxic humidifier sterilizer case which hit hard the company, citing the deterioration of business. Dismissed workers had no choice but to file a remedy request for unfair dismissal with the Labor Relations Commission. The North Jeolla Regional Labor Relations Commission and the National Labor Relations Commission respectively made subsequent adjudications in favor of the workers, ordering RB Korea to reinstate unfairly dismissed workers. In the same vein, lawmakers in the parliamentary audit and inspection of the Ministry of Employment and Labor held on October 11 called on RB Korea to implement the adjudication of the National Labor Relations Commission for the reinstatement of dismissed workers.

The management and labor union of RB Korea sat together after a long interval on October 19, one day before filing an administrative litigation by the management. The labor union made all possible concessions such as employment security and wages but only asked the company to recognize the unfair dismissal. However, the management persistently refused to accept the adjudication of unfair dismissal. It is now concerned among the workers that how long the administrative litigation would take, maybe several years, before a verdict is made.
